The Website and App are collectively referred to as the “Platform”. References to “we”, “our” or “us” or the “Company” shall mean the Platform. Any references to “you”, “your” or “user” shall mean any person or entity using our Platform. We will not use or share your information with anyone except as described in this Privacy Policy.

1.1 Personal Information

We may collect the following personal information about you:

  • Your Profile Information. When you register on the Platform, you give us information including your username, date of birth (where applicable), email address and/or telephone number, and information you disclose in your user profile.
  • Information from Third Parties. You may choose to share certain data with us from third parties or through your use of the Platform, we may collect such third party data automatically.
  • Business Partners. If you register using a social network (e.g., Facebook, Google), you will provide us or allow your social network to provide us with your username and public profile. We will likewise share certain information with your social network such as your app ID, access token and the referring URL.
1.2 Non-personal Information
  • User Content and Behavioural Information. We process the content you generate on the Platform, including preferences (such as language), photographs and videos you upload, comments, and information regarding your use of the Platform.
  • Technical Information. We automatically collect information when you use the Platform (including when using the App without an account) such as IP address, browsing history (content viewed), device model, OS, and network type.

  • Understand customer behavior and trends to improve products, services, and advertising.
  • Provide user support.
  • Personalise content you receive and provide you with tailored content.
  • Enable sharing of User Content and interaction with other users.
  • Detect and combat abuse, harmful activity, fraud, spam, and illegal activity.
  • Ensure safety and security including reviewing user content.
  • Present content effectively for you and your device.
  • Improve, promote and develop the Platform and promote popular topics, hashtags and campaigns.
  • Carry out data analysis and test the Platform to ensure stability and security.
  • Allow participation in interactive features of the Platform.
  • Verify you are old enough to use our Platform (as required by law).
  • Provide location-based services (where available in your jurisdiction).
  • Enforce our terms, conditions and policies.
  • Administer the Platform including troubleshooting.

  • Business Partners: If you register using social networks (e.g., Facebook, Twitter, Instagram, Google), you will provide us or allow your social network to provide us with your username and public profile. We may share app ID, access token, and referring URL. When you share content on social media, the video, username and accompanying text (or a link via instant messaging platforms like WhatsApp) may be shared.

  • Law Enforcement: We will share your information with law enforcement agencies, public authorities or other organisations if legally required or reasonably necessary.

Brochill may contain links to third-party websites, products, and services. When you click on third-party links, you may leave the Application, Services or Site. We do not collect your information on and through such sites, and this Policy does not address, and we are not responsible for, the privacy practices of websites operated by third parties. The inclusion of a link or accessibility of third-party websites does not imply endorsement.

3.1 Third-Party Payment Processors

Brochill works with third-party payment processors to facilitate subscription payments. Information collected by these processors is subject to their privacy policies. We are not responsible for their privacy or security practices; please review their policies before providing payment information.

3.2 Authorization for Payments

By subscribing, you authorize Brochill and its third-party payment providers to process payments for your subscription using the payment information you provide, including charges for the selected plan, applicable taxes, and other fees.

4. Users with Whom You Share Your Information

We cannot control the actions of other users with whom you share your information. We are not responsible for how other users use or share such information, or for third-party circumvention of our security measures.

5. Protection of Data

We take the security of your data very seriously. We employ administrative, physical, and electronic measures to protect your information from unauthorized access and use. However, no security measures are absolute.

When you use Brochill, data and content you share may be visible to other users and can be read, collected or used by them. You are responsible for what you choose to share.

5.1 Retention of Payment Information

Brochill does not store sensitive payment details. Third-party payment gateways may retain payment information under their policies. We may retain transaction IDs, subscription plans, and billing addresses to manage your subscription and provide support.

6. Data Deletion and Account Removal

6.1 Data Removal from Your User Account

You may remove or delete content from your account at any time.

6.2 Amendment and Deletion of Personal Information

You may correct, amend, add or delete Personal Information by logging in and visiting your profile page.

6.3 Account Deletion Request
  1. Log into your account.
  2. Visit the settings section of the App.
  3. Click on the “Account Delete Request” option.
  4. Follow the instructions to complete the request.
6.4 Retention of Historical Activities

We may retain history of activities and account records for internal purposes and legal compliance.

6.5 System E-mails

Until your account is deleted, you will continue to receive system e-mails (e.g., security notifications).

7. Intermediary Status and No Liability

We are an intermediary under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines) Rules, 2011. These Terms are published in accordance with Rule 3(1). Our role is limited to providing a platform to display content shared by users.

We do not control what people do or say and are not responsible for their actions (online or offline). Our responsibility is governed by the laws of the Republic of India and limited accordingly. You agree we will not be responsible for loss of profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms, including when we delete your content, information, or account.

We expect everyone to comply with the Brochill Content and Community Guidelines.

8. User Content

All content added, uploaded, submitted, distributed, posted to, or created using the Services by users (“User Content”), whether public or private, is the sole responsibility of the person who originated it. You represent that your User Content is accurate, complete, up-to-date, and compliant with applicable laws and does not infringe third-party intellectual property rights.

All content you access via the Services is at your own risk; you are solely responsible for any damage or loss resulting therefrom. We do not guarantee that content you access is or will remain accurate.

9. Availability of Content

We do not guarantee that any content will be available on the Site or through the Services. We may remove, edit, modify, or block any content at any time, with or without notice, for any reason or no reason.

12. Subscription Services and Payment Information

12.1 Subscription Details

Brochill may offer subscriptions for premium features/services. Subscribing may require certain personal and payment information.

12.2 Payment Gateway Providers

We use third-party payment gateway providers (e.g., Razorpay, Paytm, others) to process payments. They securely handle your payment details.

12.3 Payment Information Collection

Payment information is collected directly by the payment gateway provider. Brochill does not store or process your sensitive payment data. Please review the provider’s privacy policy.

12.4 Data Shared with Payment Providers

We may share limited personal information (e.g., name, email, plan, amount, transaction history) with processors solely to process payments and manage your subscription.

12.5 Subscription Renewal and Cancellations

For recurring subscriptions, you authorize recurring charges. You may cancel anytime via the Platform; access continues until the end of the current billing cycle.

12.6 Refunds

Refunds, if applicable, are handled by the payment processor according to their policies. For refund issues, contact the payment gateway provider.

12.7 Security of Payment Data

Transactions are encrypted and processed using industry-standard security. Brochill does not access your sensitive card data.

13. Subscription Management and Billing

13.1 Subscription and Billing Information

We collect necessary billing details (e.g., name, email) and route payment information through third-party processors.

13.2 Recurring Payments

By subscribing, you authorize Brochill and payment gateways to process recurring payments. You are responsible for managing upgrades/downgrades/cancellations.

13.3 Cancellation of Subscription

You may cancel anytime in account settings. Access continues until the end of the current billing cycle.

13.4 Billing Issues

If a payment fails, we may notify you to update your payment method. Unresolved issues may result in suspension of premium features.
